SA6 - More Lessons From Litigation: Reducing Your Facilities' Liability Risk by Targeting Process Improvement

This session will build on previous presentations by the speakers. Whether you’re a medical director, attending physician, facility administrator, or other member of the care team, the focus again will be studying cases for opportunities you can take back to your facility to use for performance improvement and risk reduction. New cases that illustrate significant teaching points are being included with tips for how to implement performance improvement activities in your nursing facility. The session will start with a basic introduction to tort litigation as applicable to nursing facilities and providers working therein, and then move on to the case studies.

Learning Objectives: 

  • Describe the main areas of litigation commonly encountered in PALTC facilities.
  • Discuss ways the medical director, physician, administrator, and director of nursing can glean lessons from PALTC litigation for use in performance improvement activities at their facilities to lessen liability risk.
  • Recognize the importance of recognition of "near miss" events and subsequent implementation of follow-up action to prevent liability with adverse outcomes.
  • Describe the importance of updated care plans that reflect appropriate goals of care for nursing facility residents in reducing the chance of litigation.
