This session will demonstrate a simulated, real-time discovery deposition of a medical director in a professional liability lawsuit. Presenters will provide an explanation of the overall discovery process in a lawsuit and the role of depositions as a tool for gathering relevant information about the merits of a claim or defense. A simulation of a deposition of the medical director of a long term care facility by an experienced attorney who specializes in lawsuits brought against these facilities will take place during the session. Participants will learn about the types of questions typically asked, the scope of questioning allowed by law, and the paramount importance of proper preparation in anticipation of a deposition. Participants will also observe first-hand how a plaintiff's counsel may use legislation that sets forth the responsibilities of a medical director to build a negligence claim using novel legal theories against the director or the facility.
