Description

This session will demonstrate a simulated, real-time discovery deposition of a medical director in a professional liability lawsuit. Presenters will provide an explanation of the overall discovery process in a lawsuit and the role of depositions as a tool for gathering relevant information about the merits of a claim or defense. A simulation of a deposition of the medical director of a long term care facility by an experienced attorney who specializes in lawsuits brought against these facilities will take place during the session. Participants will learn about the types of questions typically asked, the scope of questioning allowed by law, and the paramount importance of proper preparation in anticipation of a deposition. Participants will also observe first-hand how a plaintiff's counsel may use legislation that sets forth the responsibilities of a medical director to build a negligence claim using novel legal theories against the director or the facility. This session will conclude with a lively Q&A segment on the responsibility of the medical director and the laws that define them, and the deposition process.

  • Demonstrate the logistical and practical aspects of a deposition in professional liability actions
  • Discuss the roles and responsibilities of a medical director pursuant to law and how plaintiff's attorneys may craft legal theories of negligence based on the parameters of these laws
  • Describe proper techniques when offering deposition testimony, including techniques used by adverse counsel
  • Demonstrate how deposition testimony can be used in the pre-trial discovery and at trial
